1. Acceptance of Terms

By accessing or using Flashcarded ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.


2. Description of Service

Flashcarded is a flashcard application that helps you create, organize, and review flashcards using spaced repetition. The Service allows you to:

  • Create flashcards from conversations and text

  • Organize flashcards into decks

  • Review flashcards with optimized scheduling

  • Track your learning progress


3. Account Registration

To use Flashcarded, you must:

  • Create an account using a valid email address

  • Provide accurate and complete information

  • Maintain the security of your account credentials

  • Be at least 13 years of age

You are responsible for all activity that occurs under your account.


4. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose

  • Upload or create content that is harmful, offensive, or infringes on others' rights

  • Attempt to gain unauthorized access to the Service or its systems

  • Interfere with or disrupt the Service

  • Use automated means to access the Service beyond normal usage

  • Circumvent any usage limits or restrictions


5. User Content


Ownership

You retain ownership of the flashcards and content you create ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content solely to provide the Service to you.


Responsibility

You are solely responsible for your User Content. We do not endorse or guarantee the accuracy of any User Content.


AI-Generated Content

Flashcards generated using AI features are created based on the context you provide. You are responsible for reviewing and verifying the accuracy of AI-generated content.


6. Usage Limits

The Service may include usage limits to ensure fair access for all users and prevent abuse. These limits may include:

  • Maximum number of flashcards

  • Maximum number of decks

  • Daily card creation limits

We reserve the right to modify these limits at any time.


7. Intellectual Property

The Service, including its design, features, and technology, is owned by Raraland Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.


8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.


9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • NON-INFRINGEMENT

  • ACCURACY OR RELIABILITY OF CONTENT

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RARALAND INC. SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages

  • Any loss of data, profits, or goodwill

  • Any damages resulting from your use or inability to use the Service

Our total liability shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.


15. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

  2. Binding arbitration — If informal resolution fails, disputes shall be resolved through binding arbitration

You agree to waive any right to a jury trial or to participate in a class action.


16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.


17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Raraland Inc. regarding the Service.
